Defamation law traditionally requires three elements:

Google is expected to argue that its AI outputs are not intended as factual statements and are accompanied by disclaimers cautioning users about potential inaccuracies. It may also contend that hallucinations are an unavoidable byproduct of current AI technology, not the result of malice or negligence.
But Starbuck’s attorneys counter that disclaimers are insufficient when the system is branded as an informational tool. “If a product tells the world that my client committed horrific crimes, that’s not a harmless error,” one lawyer for Starbuck said in a press statement. “That’s defamation, regardless of whether it came from a human or an algorithm.”
Broader Implications: A Legal Frontier for AI Accountability
The case could establish a new liability framework for AI-generated content. Courts may have to determine:
- Whether AI companies can be considered “speakers” under defamation law;
- What duty they owe to individuals harmed by false AI statements;
